Trademark infringement action brought by the owners of "Lexis," "Nexis," and "Lexis-Nexis." against Innovator, a competitor that also provides an information retrieval system. Innovator bought rights to place banner advertisements keyed to plaintiff's trademarks on portal sites. When users search using plaintiff's trademarks as the keywords, the banner ad that appears above the search result is the defendant's. The court denied Innovator's motion to transfer venue on grounds that possible breach of a prior Washington settlement agreement regarding false advertising is sufficiently unrelated to the case at hand. The court also noted that a transfer merely would shift the inconvenience of litigating from Innovator to the Plaintiffs.
