A federal court dismissed a domain name dispute for lack of jurisdiction under the Anticybersquatting Consumer Protection Act (ACPA). FleetBoston Financial filed suit in federal court in Massachusetts against the Brazilian owner of the Internet domain name www.fleetbostonfinancial.com for registering the name in violation of the ACPA. The domain name was registered with Network Solutions in Herndon, Virginia. The plaintiff argued that the ACPA allowed a plaintiff to bring an action in any judicial district of the plaintiff's choosing. The court dismissed the case, holding that the ACPA does not provide in rem jurisdiction except in the judicial district in which the domain name registry or other domain name authority is located.
