Kremen had registered the Internet domain name "sex.com" in 1994. Subsequently, Network Solutions transferred the domain to another individual claiming to have Kremen's authorization, which he did not. Kremen then sued for damages from lost profits. The court ruled that people did have a property right to domain names and that Network solutions could be liable for the improper transfer of the name. The court remanded the case on the issue of damages.
