Desktop Techs., Inc. v. ColorWorks Reprod. & Design, Inc.

February 25, 1999 | Posted by Contributor | Print this page

In a trademark infringement action arising out of defendant's domain name registration for "colorworks.com", personal jurisdiction was improper over a Canadian defendant in Pennsylvania because the defendant only operated a "passive" Web site. The plaintiff owns the U.S. trademark COLORWORKS, while defendant, a Canadian company, owns the Canadian trademark "ColorWorks." Both companies prepare and print color reproductions.
