Gator.com v. L.L. Bean Inc.

LL Bean sent a cease and desist letter to Gator.com, makers of a software program, that sent pop-ups ads of LL Bean competitors to people visiting LL Bean's site. Gator.com responded by bringing suit in a California federal district court to try to get a declaration that their software was not illegal. LL Bean tried to get the case dismissed for a lack of jurisdiction. The 9th held that an out-of-state vendor, with no formal ties to the state, may still be subject to the general jurisdiction of the state because of a number of sales to residents of the jurisdiction through their e-commerce site.
