Defendants sent unsolicited bulk emails, used AOL computer systems in excess of their authority, harvested email addresses of AOL customers, and deceptively used "aol.com" in its spam headers. The court granted summary judgment for AOL for claims of Lanham Act false designation of origin and dilution, exceeding authorized access and impairing computer facilities in violation of the Computer Fraud and Abuse Act, violations of the Virginia Computer Crimes Act, and trespass to chattels under Virginia common law. Genuine issues of material fact exist as to AOL's common law conspiracy to commit trespass to chattels claim and damages issues.
